Personal bankruptcy and loss certificates

Swiss personal bankruptcy does not automatically eliminate outstanding debt. Loss certificates and the question of new assets can remain relevant afterwards. A comparison therefore needs to consider continuing claims and later financial recovery, not just procedural duration.

Understanding the reform status

The Federal Office of Justice states that the new personal debt-restructuring procedure cannot yet be used. Adopted amendments must be distinguished from law in force. A decision today should therefore not assume that future discharge options are already available.

EU proceedings and effects in Switzerland

A genuine COMI in a covered EU state can be relevant for Swiss nationals too. Switzerland is not a member state under the EU Insolvency Regulation. The effect of a foreign decision there requires separate review under Swiss recognition rules. We include Swiss creditors, assets and enforcement proceedings in the preparation.
