How long does personal insolvency really take?

A reliable timetable separates preparation, proceedings and possible later obligations. The commonly mentioned three years in Germany do not start with the first consultation. Foreign proceedings also have more than one time period.

Preparation before filing

Creditors, income, assets and procedure type must first be clarified. Consumer insolvency normally includes an out-of-court settlement attempt. Missing documents or unclear claims can extend preparation. A provider’s advertised period from the first consultation does not shorten those requirements.

Three years from opening

Germany’s assignment period is generally three years from the opening of insolvency proceedings. The court decides on discharge. Previous proceedings and statutory exceptions can change the assessment. If you have already received a discharge, provide its date and the earlier order at the outset.

Ireland: one year is not the entire commitment

Ireland’s ISI describes normal discharge from bankruptcy after one year. Income contributions may continue for up to three years and asset administration may take longer. Preparation and a genuine centre of interests add time. Compare equivalent stages with Germany rather than just two headline numbers.

What can change the timetable

Incomplete information, disputes about assets or claims and a lack of cooperation can add work. Settlement may be faster but needs funding and agreement. Duration alone therefore says little about the best economic route. Consider remaining payments, relocation costs and the impact on work.
