An insolvency application starts with a complete assessment. This page explains preparation for German consumer insolvency. Currently self-employed people, companies and foreign proceedings face different or additional requirements.

First check whether consumer insolvency fits your activity and history. With former self-employment, creditor numbers and employment-related claims matter. Applying to the wrong court or using the wrong procedure wastes time. A suitable advisory body or qualified professional can support preparation.
Provide details of creditors, claims, income and assets, supported by current statements, notices, contracts and records. Mark uncertain or disputed amounts accordingly. Missing correspondence is not a reason to omit a known creditor; the claim needs clarification instead.
Consumer insolvency normally requires a prior settlement attempt based on a plan. If it fails, certification from a suitable person or body is needed. The relevant attempt must fall within the six months before filing. An informal refusal from one creditor does not replace the required certification.
Complete the required official information and, where sought, the discharge application. If assets cannot cover costs, consider a separate cost-deferral request. Respond to court requests for missing information in time. Contacting a firm does not itself open proceedings or stop attachment.
For liabilities above EUR 80,000, we assess your situation and German or European options. Legal steps involve the appropriate professionals. Bring court correspondence and delivery dates so urgent issues can be distinguished from longer-term debt planning.
